These Terms of Service ("Terms") govern your use of AIAnswerPhone's AI call answering service ("Service"). By accessing or using our Service, you agree to be bound by these Terms. If you do not agree, please do not use our Service.

  • "Service": Our AI-powered call answering and lead capture service
  • "Subscription": Your paid plan for accessing the Service
  • "Call Data": Recordings, transcripts, and information collected during calls

2. Acceptance of Terms

By creating an account, subscribing to our Service, or using any part of our platform, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy.

3. Service Description

AIAnswerPhone provides an AI-powered virtual receptionist service that:

  • Answers incoming calls using artificial intelligence
  • Captures caller information and enquiry details
  • Generates call transcripts and notifications
  • Routes calls based on intent and department
  • Provides spam call protection

We reserve the right to modify, suspend, or discontinue any aspect of the Service at any time with reasonable notice.

4. Account Registration

4.1 Eligibility

You must:

  • Be at least 18 years old
  • Have the legal capacity to enter into contracts
  • Provide accurate and complete registration information
  • Maintain the security of your account credentials

4.2 Account Responsibilities

You are responsible for:

  • All activities under your account
  • Maintaining the confidentiality of your password
  • Notifying us immediately of unauthorised access
  • Ensuring your contact information is current

5. Subscription Plans and Payment

5.1 Subscription Plans

We offer various subscription plans with different features, call minutes, and pricing. Details are available on our pricing page. All prices are in British Pounds (GBP) and include VAT where applicable.

5.2 Payment Terms

  • Subscriptions are billed monthly in advance
  • Payment is processed securely through Stripe
  • You authorise us to charge your payment method automatically
  • Failed payments may result in service suspension

5.3 Refunds

Refunds are provided at our discretion. If you cancel within 14 days of initial subscription, you may be entitled to a full refund under UK consumer protection laws. No refunds are provided for partial months or unused minutes.

5.4 Price Changes

We reserve the right to modify subscription prices. Existing customers will be notified at least 30 days before price changes take effect. Continued use after the effective date constitutes acceptance of new pricing.

6. Use of Service

6.1 Permitted Use

You may use the Service for lawful business purposes only, in accordance with these Terms and applicable UK laws.

6.2 Prohibited Activities

You agree not to:

  • Use the Service for illegal, fraudulent, or harmful purposes
  • Interfere with or disrupt the Service or servers

7. Call Minutes and Usage

Your subscription includes a monthly allocation of call minutes. Unused minutes do not roll over to the next month. If you exceed your plan's minutes, we will notify you and may require an upgrade to a higher plan.

8. Intellectual Property

8.1 Our Rights

All content, features, and functionality of the Service, including but not limited to text, graphics, logos, software, and AI models, are owned by AIAnswerPhone or its licensors and are protected by UK and international copyright, trademark, and other intellectual property laws.

8.2 Your Content

You retain ownership of your call data and content. By using the Service, you grant us a licence to use, process, and store your data as necessary to provide the Service, as detailed in our Privacy Policy.

9. Data Protection and Privacy

We handle your personal data in accordance with UK GDPR and the Data Protection Act 2018. Please review our Privacy Policy for details on how we collect, use, and protect your information.

10. Service Availability

While we strive for 99.9% uptime, we do not guarantee uninterrupted or error-free service. The Service may be unavailable due to:

  • Scheduled maintenance
  • Technical issues or failures
  • Force majeure events
  • Third-party service disruptions

11. Limitation of Liability

11.1 Disclaimer

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DISCLAIM ALL WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

11.2 Limitation

To the maximum extent permitted by UK law, our total liability for any claims arising from or related to the Service shall not exceed the amount you paid us in the 12 months preceding the claim.

11.3 Exclusions

Nothing in these Terms excludes or limits our liability for:

  • Death or personal injury caused by negligence
  • Fraud or fraudulent misrepresentation
  • Any other liability that cannot be excluded by law

12. Indemnification

13. Cancellation and Termination

13.1 Cancellation by You

You may cancel your subscription at any time through your account dashboard or by contacting us. Cancellation takes effect at the end of your current billing period. You will continue to have access until the period ends.

13.2 Termination by Us

We may suspend or terminate your account immediately if:

  • You breach these Terms
  • You fail to pay fees when due
  • You engage in fraudulent or illegal activity
  • We are required to do so by law

13.3 Effect of Termination

Upon termination:

  • Your access to the Service will cease
  • You remain liable for all charges incurred
  • We may delete your account and data (subject to legal retention requirements)

14. Dispute Resolution

14.1 UK Law

These Terms are governed by the laws of England and Wales. Any disputes will be subject to the exclusive jurisdiction of the courts of England and Wales.

These Terms, together with our Privacy Policy, constitute the entire agreement between you and AIAnswerPhone regarding the Service.

16.2 Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full effect.

16.3 Waiver

Our failure to enforce any right or provision does not constitute a waiver of that right or provision.

16.4 Assignment

You may not assign these Terms without our written consent. We may assign these Terms in connection with a merger, acquisition, or sale of assets.
